DATA PROTECTION

1.Purpose (legal grounds for processing)
The personal data you provide to us will be used for the following purposes:

(a) to provide internal registration services and related services as preconditions for the conclusion and execution of commercial contracts, and for the protection of credit positions (supplier/customer) arising from such contracts (performance of the contract between the parties)
(b) to meet operational, management, administrative and documentary requirements, including communications through mail order forms, invoices, RMAs, external technical service documentation and commercial invoices, all for the purpose of complying with obligations established under applicable legislation, in particular commercial and tax law
(c) to enable access to and navigation of the websites, to produce anonymous statistics on their use, to monitor their functioning and to verify possible liabilities in the event of unlawful acts (legitimate interest of Aleksei Sysoev)

The processing of your personal data will include, in addition to its collection, its recording, storage, modification, communication and deletion, carried out in an automated or semi-automated manner. The personal data processed by Aleksei Sysoev are subject to appropriate security measures to ensure their protection, including user identification and authentication, logical and physical access control, management, disposal and reuse of storage media, backup and data recovery procedures, and the management of incidents and security breaches. These measures are strictly necessary to fulfil the purposes set out in point 1.

For the purposes referred to in points (a) and (b), your data will be retained for the period required by law.
For the purpose referred to in point (c), the data will be retained for two years.
For the purpose referred to in point (d), the data will be retained until consent is withdrawn or the contractual relationship is terminated.

What are cookies?

WITHDRAWAL POLICY (RETURNS), INCIDENTS AND TECHNICAL SUPPORT

Aleksei Sysoev complies with current regulations and will accept the return of an item (withdrawal), always within 14 calendar days from the receipt of the same, if the customer has not used the product for the intended purpose. Refunds are not possible if you have used the paid functionality. 

Not valid for companies and professionals!
To accept the return of the item and request for withdrawal the customer must comply with the following conditions:
– You must notify your decision to withdraw by means of an unambiguous statement. A withdrawal request form is made available to the consumer and user.

The customer will always receive a notification that the withdrawal request has been received.
The refund of the money will be made within a maximum period of 14 calendar days from the date on which the notification of the decision to withdraw from the contract was made. All payments will be refunded using the same means of payment used by the user for the initial transaction.

All communications related to the user account (including technical inquiries, support requests, and financial matters) are accepted only from the email address associated with that account. Requests sent from other email addresses will not be processed.

FORMS (METHODS) OF PAYMENT

There are two payment methods fixed on the website so that the customer can manage his order request. At the customer’s choice.

  • Credit or debit card: via BBVA or Stripe online payment system.
  • Apple Pay / Google Pay through Stripe online payment system.

ACCOUNT POLICY

Commercial accounts* cannot be used on more than one PC / laptop. If you plan to use VCTool on more than one PC, a separate account/license must be used for each.

Commercial accounts for VCTool are tethered to the distinct hardware ID of the computer or laptop in use. Users can independently reset this linkage via their personal accounts, but this operation is restricted to a maximum of twice per month and once per day (24 h). Over the course of a year, a total of 24 resets are permitted for annual subscriptions. Any additional reset requests for commercial accounts must be directed to our technical support team. For security reasons, requests for account unlinking are not accepted through contact forms! The request must be sent from the email associated with your account to support@vctool.app.

The unbinding system is intended solely for cases where a PC replacement is required, or changes have been made to the hardware configuration that result in a change to the PC’s hardware identifier (such as updates to system drivers, BIOS, etc.).

Use of commercial accounts* in remote desktop sessions (RDP) is not permitted. Any use of the software in this mode will be considered a violation of the product’s terms of use.

Accounts with no activity within 6 months of registration are considered abandoned and are subject to automatic deletion. Activity is defined as one of the following: logging into the VCTool desktop application with your credentials; connecting to a vehicle; or adding funds to the account balance.

* A commercial account means an account with any valid subscription, or with at least one purchased standalone module.

SUBSCRIPTION POLICY

VCTool offers two types of subscriptions: monthly and annual.

Monthly subscriptions, including Lite, Lite Plus, Pro, and Ultimate, remain active for one calendar month from the date of activation. Cancellation or suspension of monthly subscriptions is not permitted, except for the Lite Plus subscription, which can be terminated early if the limit of allowed connections is reached.

Annual subscriptions such as Lite, Pro, and Ultimate are valid for one calendar year and can be renewed at a 15% (Lite), 20% (Pro) and 25% (Ultimate) discount off the original price within one month before their expiry.

Deprecated Full and Light subscriptions can be renewed under their original terms, but only within three months following their expiration. Failure to renew within this period will result in a permanent loss of the renewal option. The duration of the extended subscription is calculated from the expiration date of the previous period. When switching to a different subscription type, returning to an archived subscription type becomes impossible.

Users can upgrade their subscription to a more advanced plan: during the first month of the subscription, an upgrade to a higher tier is available by paying the difference in price between the plans. Starting from the second month, the upgrade is discounted based on the value of the full unused months of the current subscription. The original subscription is canceled, and the new subscription is activated for the full term (this applies only to annual Lite and Pro subscriptions).

Subscription cancellation is only possible if none of the paid features included in the subscription have been used. Cancellation is executed only through a request to technical support.

Preset Usage Policy for One-Click Feature Activation

Access to presets is determined by the active subscription. If a preset is not included in the subscription and has a non-zero cost, it is paid for once per VIN, provided the preset execution is successful.

If the declared result is not achieved for any reason after executing a preset, the payment can be contested, but only under the following conditions: the user must provide proof that the preset did not produce the claimed effect (video evidence showing the absence of effect immediately after activation). After that, the preset must be reverted (deactivated). Access to the backup of the control unit where the issue occurred must also be provided. If confirmation is not provided or the preset is not deactivated, the refund request may be denied.
Requests for preset payment cancellations are accepted only within 14 days of payment.

Presets for one-click feature activation do not include access to SFD unlocking, Porsche Security Lock, or other services.

SUPPORT POLICY

Our technical support is limited to issues caused by software errors or problems arising during the use of the software, provided they are directly related to the software itself. We do not provide support for issues caused by insufficient user training. Additionally, we do not offer assistance related to vehicle interactions or provide training services.
