APPLICABLE LAW AND JURISDICTION
These terms shall be governed by Spanish law. Where the user acts as a consumer, any dispute shall be submitted to the courts and tribunals determined by applicable consumer protection law. In all other cases, the parties submit to the courts and tribunals competent under Spanish law. For users acting as companies or professionals, the parties expressly submit to the courts and tribunals of Málaga, unless otherwise required by applicable law.
PRIVACY AND DATA PROTECTION POLICY
In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights, we inform users that the personal data provided through this website will be processed by Aleksei Sysoev for the purpose of managing user accounts, providing the requested services, processing payments, issuing invoices, handling support requests and, where applicable, sending commercial communications when the user has given the required consent.
1. Purpose (legal grounds for processing)
The personal data you provide to us will be used for the following purposes:
(a) to create and manage user accounts, provide access to VCTool services, process purchases, subscriptions, modules, account balance operations and other paid functionality, and manage the contractual or pre-contractual relationship with the user;
(b) to meet operational, management, administrative and documentary requirements, including communications through mail order forms, invoices, RMAs, external technical service documentation and commercial invoices, all for the purpose of complying with obligations established under applicable legislation, in particular commercial and tax law;
(c) to enable access to and navigation of the Website, monitor its operation, maintain security, prevent abuse and, where applicable, produce usage statistics in accordance with the Cookie Policy and the user’s cookie preferences;
(d) to carry out marketing, commercial and informational activities, including the sending of newsletters or promotional communications, only where the user has given the required consent or where otherwise permitted by applicable law.
The collection of data for the contractual purposes set out in points (a), (b) and (c) is mandatory and necessary. Failure to provide such data will make it impossible to proceed with the commercial purchase and the provision of services.
For marketing communications, consent will be requested through the corresponding forms or consent mechanisms. The user may withdraw consent at any time by contacting info@vctool.app or by using the unsubscribe mechanism, where available.
2. Communication of data / transfer of data to third parties
The personal data collected may be communicated, where necessary and in accordance with applicable law, to payment service providers, banks, hosting and IT service providers, email and communication service providers, accounting and tax advisors, legal advisors, public administrations and competent authorities, and other service providers strictly necessary for the operation of the Website, provision of the services, payment processing, invoicing, accounting, legal compliance and support.
Personal data will not be sold or publicly disclosed by Aleksei Sysoev.
Where a specific paid service requires the involvement of a third-party provider, only the data necessary to process that request may be shared with that provider.
3. Processing of personal data
The processing of your personal data will include, in addition to its collection, its recording, storage, modification, communication and deletion, carried out in an automated or semi-automated manner. Your personal data may be preserved in paper format and/or electronic form. The personal data processed by Aleksei Sysoev are subject to appropriate security measures to ensure their protection, including user identification and authentication, logical and physical access control, management, disposal and reuse of storage media, backup and data recovery procedures, and the management of incidents and security breaches. These measures are strictly necessary to fulfil the purposes set out in point 1.
For the purposes referred to in points (a) and (b), your data will be retained for the period required by law.
For security, technical and access logs, data will be retained for the period necessary to ensure the security and proper operation of the Website and to determine possible liabilities, and in any case for no longer than the period permitted by applicable law.
For the purpose referred to in point (d), the data will be retained until consent is withdrawn or the contractual relationship is terminated.
4. Rights of the data subject in relation to the processing of personal data
In accordance with the GDPR, the user may exercise the rights of access, rectification, erasure, restriction of processing, objection and data portability, where applicable. The user also has the right to withdraw consent at any time for processing activities based on consent, without affecting the lawfulness of processing carried out before withdrawal.
The user may exercise these rights by sending an email to info@vctool.app. The user also has the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) or another competent supervisory authority.

REFUNDS
The Developer complies with the applicable rules and accepts refund requests for the Product* within 14 calendar days from the date of purchase, provided that the Client has not used the Product for its intended purpose, meaning that none of the functions included in the paid Product have been used.
This refund policy applies to consumers. It does not apply to companies or professional users, unless otherwise required by applicable law.
To request a refund and withdraw from the purchase, the Client must send an unequivocal statement of their decision by email to: info@vctool.app
The Developer will always send the Client a notification confirming receipt of the refund request.
Refunds are issued within no more than 14 calendar days from the date the notification of the decision to withdraw from the purchase is received. All payments will be refunded using the same payment method used by the Client for the initial transaction. Partial refunds are not available.
All requests related to an account, including technical requests, support requests and financial matters, are accepted exclusively from the email address associated with that account. Requests sent from other email addresses will not be considered.
* Product means any paid functionality, including a subscription, module, request package or data package.
FORMS (METHODS) OF PAYMENT
The Website offers the following payment methods, subject to availability at the time of purchase:
- Credit or debit card via BBVA or Stripe.
- Apple Pay / Google Pay via Stripe.
By completing a payment on the website, the customer confirms that the payment instrument used for the transaction (including a bank card, Apple Pay, or Google Pay) belongs to them and that they are the authorized holder of the payment method used.
The use of third-party payment instruments, including bank cards belonging to friends, relatives, or any other persons, is strictly prohibited.
If a payment is made using a payment method that does not belong to the account holder and the cardholder subsequently initiates a chargeback, dispute or fraud claim, the associated user account may be suspended or permanently blocked, depending on the circumstances. Access may be restored only after the issue has been resolved and the legitimacy of the payment has been confirmed.
ACCOUNT POLICY
Commercial accounts* cannot be used on more than one PC / laptop. If you plan to use VCTool on more than one PC, a separate account/license must be used for each; alternatively, for non-parallel use on different computers, you may link your account to a YubiKey hardware security key via the Mobility Add-on module and use the account on any PC where the key is physically present.
Commercial accounts for VCTool are linked to the unique hardware ID of the computer or laptop in use. Users may independently reset this binding no more than once per 24 hours and no more than twice per calendar month. For annual subscriptions, this means a maximum of 24 resets during the subscription year. Any additional reset requests for commercial accounts must be directed to our technical support team. For security reasons, requests for account unlinking are not accepted through contact forms! The request must be sent from the email associated with your account to support@vctool.app.
The unbinding system is intended solely for cases where a PC replacement is required, or changes have been made to the hardware configuration that result in a change to the PC’s hardware identifier (such as updates to system drivers, BIOS, etc.).
Users may link their account to a YubiKey hardware token that supports Smart Card (PIV) technology by using the paid Mobility Add-on module (not included in subscriptions). The cost of the hardware key is not included in the module price; the key must be purchased separately by the user from the manufacturer or authorized distributors. The hardware key allows the user to access the account on any PC without performing a re-binding procedure, however only one computer may be used at the same time. The hardware key must remain connected to the PC throughout the entire VCTool session; if the key is removed, it must be reconnected within 2 minutes, otherwise the VCTool application will automatically close regardless of the current context. The user may unlink the key from the account at any time, after which the system returns to the standard binding mechanism. An unlinked key cannot be linked again to the same account for 1 month from the moment of unlinking, including requests to technical support, regardless of the reason for unlinking. Linking new keys is allowed no more than once per 24 hours and no more than twice per calendar month. Transferring a key linked to an account to third parties is prohibited. If abuse is detected (such as transferring the key, selling access via remote control, etc.), the account may be suspended or permanently blocked, depending on the circumstances. The use of VCTool inside virtual machines requires a linked hardware key; starting from May 1, 2026, authorization inside a virtual machine without a key will not be possible.
Use of commercial accounts* in remote desktop sessions (RDP) is not permitted. Any use of the software in this mode will be considered a violation of the product’s terms of use.
Accounts with no activity within 6 months of registration are considered abandoned and are subject to automatic deletion. Activity is defined as one of the following: logging into the VCTool desktop application with your credentials; connecting to a vehicle; or adding funds to the account balance.
* A commercial account means an account with any valid subscription, purchased standalone module, paid request package, data package, or other paid functionality.
SUBSCRIPTION POLICY
VCTool offers two types of subscriptions: monthly and annual.
Monthly subscriptions, including Lite, Lite Plus, Pro, and Ultimate, remain active for one calendar month from the date of activation. Cancellation or suspension of monthly subscriptions is not permitted, except for the Lite Plus subscription, which can be terminated early if the limit of allowed connections is reached.
Annual subscriptions such as Lite, Pro, and Ultimate are valid for one calendar year and can be renewed at a 15% (Lite), 20% (Pro) and 25% (Ultimate) discount off the original price within one month before their expiry.
Deprecated Full and Light subscriptions can be renewed under their original terms, but only within three months following their expiration. Failure to renew within this period will result in a permanent loss of the renewal option. The duration of the extended subscription is calculated from the expiration date of the previous period. When switching to a different subscription type, returning to an archived subscription type becomes impossible.
Users can upgrade their subscription to a more advanced plan: during the first month of the subscription, an upgrade to a higher tier is available by paying the difference in price between the plans. Starting from the second month, the upgrade is discounted based on the value of the full unused months of the current subscription. The original subscription is canceled, and the new subscription is activated for the full term (this applies only to annual Lite and Pro subscriptions).
A refund or withdrawal request for a subscription is only possible if none of the paid features included in the subscription have been used. Such requests are processed only through technical support and in accordance with the Refunds section.
PRESET USAGE POLICY
Access to presets is determined by the active subscription. If a preset is not included in the subscription and has a non-zero cost, it is paid for once per VIN, provided the preset execution is successful.
If the declared result is not achieved for any reason after executing a preset, the user may request a review of the payment, but only under the following conditions: the user must provide proof that the preset did not produce the claimed effect (video evidence showing the absence of effect immediately after activation). After that, the preset must be reverted (deactivated). Access to the backup of the control unit where the issue occurred must also be provided. If confirmation is not provided or the preset is not deactivated, the refund request may be denied.
Requests for cancellation or refund of a preset payment are accepted only within 14 calendar days from the date of payment and are subject to the conditions set out in this section.
Presets for one-click feature activation do not include access to SFD unlocking, Porsche Security Lock, or other services.
SUPPORT POLICY
Technical support is limited to issues directly related to the operation of VCTool software. We do not provide training on vehicle systems, retrofitting, coding, parameterization, flashing strategies, repair procedures, or the consequences of applying specific changes to a vehicle. The user is responsible for ensuring that any operation performed with the software is appropriate for the specific vehicle and complies with applicable requirements. Support does not include analysis of whether a specific coding, adaptation, dataset, flashing operation or retrofit is suitable, safe or legally permitted for a particular vehicle.
INTELLECTUAL PROPERTY AND SOFTWARE USE
All content, software, databases, documentation, trademarks, trade names, logos and other materials available through the Website or VCTool software are owned by Aleksei Sysoev or by their respective rights holders and are protected by applicable intellectual property laws.
The purchase of a subscription, module, request package, data package or any other paid functionality grants the user a limited, non-exclusive, non-transferable right to use the corresponding functionality under the applicable conditions. It does not transfer ownership of the software, databases, files, datasets or any related intellectual property.
The user may not copy, resell, redistribute, reverse engineer, bypass technical restrictions, share access credentials, or provide unauthorized access to VCTool software, server databases, datasets, flash containers or other protected resources, unless expressly permitted in writing by the Developer.
THIRD-PARTY SERVICES AND OEM INDEPENDENCE
VCTool is an independent software product and is not affiliated with, endorsed by or sponsored by Volkswagen AG, Audi AG, Škoda Auto, SEAT/CUPRA or any other vehicle manufacturer.
Access to third-party services, OEM online services, security tokens, accounts, files, datasets, flash containers or other external resources is not included unless expressly stated. The user is responsible for ensuring that they have the necessary rights, authorizations and legal basis to use any third-party or OEM service in connection with VCTool.
LIMITATION OF RESPONSIBILITY
VCTool is a professional diagnostic and service software tool. Operations such as coding, adaptation, parameterization, flashing, dataset writing, feature activation and other vehicle-related actions may affect the operation of vehicle systems.
The user is solely responsible for verifying that any operation performed is appropriate for the specific vehicle, control unit, software version and legal requirements applicable in their jurisdiction. The Developer is not responsible for damage, malfunction, loss of functionality, incompatibility or legal consequences resulting from incorrect use, insufficient expertise, use of unsuitable files or data, interrupted procedures, defective interfaces, unstable power supply, or actions performed without proper authorization.
